Resolving Problems With Access to Children in Texas Divorce

The Texas Standard Possession Order in divorce provides a default schedule for the division of physical custody (also known as "possession") between the parent the child lives with and the other parent. Most divorcing parents will find it desirable to work toward an agreement that varies the terms of the Standard Possession Order, and many will find it necessary to contest the details of visitation ("access to the child") in facilitated mediation or in a family court hearing. While the Texas Standard Possession Order serves as a guideline for periods of possession, it is presumed to be appropriate for children ages three and over, and the courts will often order "Standard Possession" in absence of an agreement to the contrary.
